Article 1 : Definitions
The following definitions apply to all the general terms of use:
- "Directory" refers to all healthcare professionals registered on the Loosto platform.
- "Application" refers to the mobile application operated by Loosto and available on Android.
- "T&C" refers to the present terms and conditions.
- "Platform" refers to the connection platform operated by Loosto through the website and the Application.
- "Patient" refers to a User who has requested the services of a Practitioner.
- "Practitioner" refers to a professional operating in the healthcare sector.
- "User" refers to any natural person who uses the site to benefit from our Services.
- "Service" refers to the provision of the Directory, the possibility to make medical appointments online, and access to the "Health Awakening" blog.
- "Company" refers to the Loosto SARL company which publishes, operates the Loosto platform, and provides the Service to Users and Practitioners.
- "Loosto Advisor" refers to a commercial agent of the Company in charge of customer relations.
Article 2 : Purpose
These General Terms of Use aim to define the terms and conditions of use of Loosto's services and the rights and obligations of Loosto and the User.
The Loosto platform allows:
- Practitioners to reference themselves and offer their services online.
- Users to search for Practitioners in our Directory, make medical appointments online, and consult health content.
Article 3 : Service Description
3.1 Directory
The Directory lists all the Practitioners on the Loosto platform. The User can search for a Practitioner in the Directory based on their specialty, location, and service rates. The User can also view a Practitioner's profile or make an appointment with them. A Practitioner's profile allows the user to identify them: name, surname, specialty, and profile picture (optional); but also to know their workplace, consult their availability, services, and health articles.
3.2 Online Appointment Booking
3.2.1 Appointment Request
The User can request an appointment with a Practitioner. To do this, they must select a Practitioner in the Directory and click on the "Book Appointment" button. The User will then be prompted to indicate their reason for consultation and availability. Finally, they must identify themselves and confirm their intention to make an appointment online.
3.2.2 Loosto Assistance
Following a User's appointment request, a Loosto Advisor takes care of the rest of the procedure to organize the appointment with the selected Practitioner. They listen to the User and ensure that the appointment goes smoothly. The Loosto Advisor is bound by medical confidentiality.
3.2.3 Appointment Confirmation
To confirm an appointment with a Practitioner, the User must pay an advance consultation fee to Loosto. Following their payment, they receive confirmation of their appointment (date, precise time, and name of the healthcare professional) as well as all the necessary instructions for their care by the Practitioner.
3.2.4 Appointment Management
The User and the Practitioner can reschedule or even cancel an appointment under certain conditions described below:
- Modification Conditions for the Practitioner:
The Practitioner who wishes to reschedule or cancel an appointment undertakes to inform the User at least 48 hours (excluding Saturdays, Sundays, and public holidays) before the appointment time. In this case, the User will not be entitled to any form of compensation for any inconvenience caused.
If the Practitioner cancels an appointment less than 48 hours (excluding Saturdays, Sundays, and public holidays) before the appointment time, the User may receive a 10% discount voucher for the canceled service. This discount voucher can be used for their next appointments on the Loosto platform and is valid for one year from its issue date.
Under the same conditions, the User can contact a Loosto Advisor to assist them in rescheduling or canceling an appointment.
3.2.5 Refund in case of cancellation
In case of appointment cancellation, the reimbursement of fees will be made within 48 hours (excluding Saturdays, Sundays, and public holidays) following the receipt of the appointment cancellation request.
3.3 "Health Awakening" Blog
The "Health Awakening" blog offers Users healthcare content written by Practitioners. The topics covered are diverse and presented in different forms: articles, videos, and practical sheets. Through its blog, the Loosto platform promotes health prevention and provides Users with reliable information to help them stay healthy.
3.4 Service Prices
The User has free access to all the services of the Loosto platform. Thus, searching for a Practitioner in the Directory, accessing the contents of the "Health Awakening" blog, and making appointments are free.
However, while the Services offered by the Loosto platform are free, the services of the Practitioners are paid. In other words, to validate an appointment with a Practitioner, the User must pay an advance on the Practitioner's fees for the service to the Loosto Advisor handling their file. The Loosto platform does not add any additional fees to the amounts of fees indicated by its Practitioners.
3.5 Service Limitations
Registration on the Loosto platform is open to all Practitioners who request it. Thus, only Practitioners registered on the Loosto platform can benefit from the services offered and appear in the Directory.
The service of searching for a Practitioner and making an appointment online is offered free of charge to the User. It is understood, however, that medical acts or care provided by the Practitioner as part of an appointment made via the platform will be subject to invoicing of fees, in accordance with the care agreements in force with that Practitioner.
The implementation of the Service by the Practitioner is entirely the responsibility of the Practitioner. The Company cannot be held responsible for the non-performance or improper performance of the Service offered by the Practitioner and cannot be liable for any expenses incurred by the User in this regard. The use of the Service by the Practitioner does not exempt or mitigate them in any way from their professional obligations and liability towards the User.
Article 4 : Information Provided by Practitioners
The Service is offered at the request of the Practitioner. As part of their registration on the platform, the Practitioner provides information about themselves or their medical practice. The practitioner is responsible for updating their information.
This information provided by Practitioners is the sole responsibility of the Practitioner who certifies on their honor that all personal information is true.
Therefore, the Loosto platform provides no guarantee as to the accuracy, completeness, timeliness, completeness, or content of the data concerning the Practitioners appearing on the platform.
Article 5 : Rules for using the service
5.1 Acceptance of the Terms of Use of the Service
These General Terms of Use of the Service aim to define the conditions under which the User can benefit from the Service provided by the Company. The use of this Service is subject to the unconditional acceptance by the User of the General Terms of Use of the Service.
By accessing the platform and benefiting from the Service, the User acknowledges having read and understood the entirety of these General Terms of Use and accepts them without restriction or reservation.
If the User does not accept these conditions, they must stop using the platform and waive the benefit of the Service offered by the Company.
5.2 Conditions for accessing the Service
The Loosto platform is accessible to any user and subject to the following conditions:
The User must be at least 18 years old to benefit from the services of the Loosto platform and must consent to the collection and processing of personal data to ensure the proper functioning of the Service.
5.3 Service provided by the Practitioner
The services provided by the practitioner engage their sole responsibility. Consequently, Loosto cannot be held responsible for any act or event occurring in the context of the relationship between the User and the Practitioner.
5.4 Deletion or definitive termination of the service(s)
In the event of a violation of the General Terms of Use or any unlawful act, Loosto is entitled to immediately remove certain content from the Site and/or to suspend or delete any User Account or to take other appropriate measures against it, without notice.
Article 6 : Limitation of Liability
6.1 Service Availability
The Service of the Loosto platform is available 24 hours a day, 7 days a week. However, given the specificities of the Internet network, no guarantee of continuity of service is offered, Loosto being only bound by an obligation of means in this regard.
Loosto cannot be held responsible for any damages related to the temporary inability to access one of the services offered.
6.2 Site Modification
The Company reserves the right to modify, interrupt, at any time, temporarily or permanently all or part of the Service without prior information to Users and without entitlement to compensation.
6.3 User Responsibility
The User is solely responsible for their use of the platform and the Service they access.
The Company cannot be held liable in any way in the event of legal proceedings brought against the User who has engaged in non-compliant use of the platform and/or the Service it provides.
6.4 Force Majeure
Loosto's liability cannot be sought if the performance of one of its obligations is prevented or delayed due to a force majeure event as defined by case law, including natural disasters, fires, malfunctions, or interruption of the telecommunications network or the power grid.
Article 7 : Protection of Personal Data
7.1 Personal Data
Registration on the platform requires the User to provide their personal information such as:
- Their mobile phone number
- Their first and last name(s)
- Their email address
- Their password
- Their date of birth
- Their gender
For practitioners, additional information such as:
- The registration number with the National Council of Physicians
- Specialties
The User undertakes to provide and register on the platform only truthful, sincere, regular, and faithful information about their contact details and their needs.
7.2 Use of Data
The hosting of data produced as part of the implementation of the Service is provided and guaranteed by the host ONLINE. The User has a right of access and rectification of their data.

Article 8 : Intellectual Property
The Loosto platform constitutes a protected work under intellectual property law.
All elements (trademarks, designs, texts, hypertext links, logos, images, videos, sound elements, software, layout, database, codes, etc.) contained on the Site are protected by national and international intellectual property law.
It is prohibited for the User, except with the prior written authorization of LOOSTO, to carry out any reproduction, representation, reissue, redistribution, adaptation, translation, and/or partial or complete transformation of any element composing the whatheatlh.com platform.
Failure to comply with this prohibition constitutes an act of infringement and/or unfair or parasitic competition that may engage the civil and criminal liability of the User.
Article 9 : Applicable Law and Jurisdiction
9.1 Applicable Law
The relations established between the Loosto website and the User, governed in particular by these TOS, are subject to Cameroonian law, to the exclusion of any other state legislation.
9.2 Jurisdiction
Any dispute between the User and the Loosto platform concerning the formation, interpretation, or execution of these TOS will be brought before a competent court, in the event of failure of the attempt to resolve the dispute amicably prior to contentious action.
